Terms of service
Last updated October 5, 2026
These Terms of Service govern your use of the Hawthorne & Reed website at hawthorneandreed.com and your purchase of any piece from us. By using this site or placing an order, you agree to these terms. Please read them before you buy.
1. Who we are
Hawthorne & Reed is an online retailer of coffee tables and lighting, based in California. We are a retailer, not a manufacturer: we select the pieces we sell and present them in three styles, Japandi, Modern and Organic, but we do not design or make them. In these terms, “we”, “us” and “our” mean Hawthorne & Reed, and “you” means the person using this site or placing an order.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you confirm that you meet that requirement and that the payment method you use is your own or that you are authorized to use it.
3. Where we sell
We sell and deliver within the United States only, to the 48 contiguous states and Washington, D.C. We do not accept orders for delivery to Alaska, Hawaii, U.S. territories, military addresses or any address outside the United States, and we cannot arrange onward shipping abroad.
4. Pieces, descriptions and images
We describe each piece as accurately as we can, including its measurements, materials and finish. Measurements on a product page are the assembled dimensions, given to the nearest practical fraction of an inch, and may vary slightly between production runs.
Product images show a representative example of each piece, and some are digital renderings rather than photographs of the piece itself. Natural materials such as wood and stone vary from piece to piece, and colors can look different from one screen to another. Where an image and the written description differ, the written description and measurements apply. A minor variation of this kind is not a fault, but if a piece is not what you expected, you may still return it under our Refund Policy.
5. Prices and availability
All prices are in U.S. dollars and may change at any time before you place an order. Availability is not guaranteed until your order is accepted. Prices do not include sales tax; any tax that applies is calculated and shown at checkout before you confirm your order.
Despite our care, a listing may occasionally carry an error in its price or description. Where that happens we may cancel the affected order, even after it has been confirmed. We will always contact you first, and you will not be charged for a canceled order; if payment has already been taken, we refund it in full.
6. Orders and acceptance
Your order is an offer to buy. Our order confirmation email acknowledges that we have received it; it is not acceptance. The contract between us is formed when we dispatch the piece. We may decline or cancel any order, including where a piece is unavailable, where we cannot deliver to the address given, where payment cannot be verified, or where an error of the kind described in section 5 has occurred.
7. Payment
We accept the payment methods shown at checkout, which include major credit and debit cards, Shop Pay, PayPal, Apple Pay and Google Pay. Card payments are processed by Shopify Payments over an encrypted connection, and we do not see or store your full card details. If you pay with PayPal, your payment is handled by PayPal under its own terms.
When you place an order, your payment is authorized but not yet taken. We take payment once the 24-hour cancellation window described in section 9 has closed. If you cancel within that window, or we cancel your order, the authorization is released and you are not charged. Your bank decides how quickly a released authorization leaves your statement.
Where Shop Pay Installments is offered at checkout, it is subject to an eligibility check and to the provider’s own terms, which you accept separately.
8. Delivery, risk and title
Delivery is governed by our Shipping Policy, which forms part of these terms. Standard Delivery is free and is the only delivery method we offer: the piece is delivered by carrier to your door, boxed, for you to unpack and, where needed, assemble. It is not carried inside. Delivery dates are estimates, not guarantees.
A piece remains our responsibility until it is delivered; risk in it passes to you on delivery. Title passes to you once we have received payment in full.
9. Cancellations, returns and refunds
Our Refund Policy forms part of these terms. In summary:
- You may cancel a new order at no cost within 24 hours of placing it.
- You may return a piece within 21 days of delivery. Return shipping is the customer’s responsibility. A 10% repacking deduction applies to pieces returned without their original packaging.
- If a piece arrives damaged, faulty or incorrect, tell us within 48 hours of delivery, including damage you find while unpacking or assembling, and we put it right at our cost.
The Refund Policy sets out these commitments in full and prevails over this summary.
10. Warranty on the pieces we sell
Because we select rather than manufacture, warranty coverage varies from piece to piece. We do not publish a single warranty period across the collection. Ask us about a specific piece before you order and we will confirm in writing what coverage applies to it, including telling you plainly if it carries none.
Separately from any product warranty, the cancellation, return and damage commitments in section 9 are our own and apply to every piece we sell. Nothing in these terms limits any statutory right you have that cannot be limited by agreement.
11. Your account
If you create an account, you are responsible for activity under it and for keeping access to the email address you sign in with secure. Tell us promptly if you believe your account has been used without your permission.
12. Acceptable use
You agree not to use this site to break the law, to infringe anyone’s rights, to introduce malicious code, to scrape or harvest data by automated means, to interfere with the site’s operation, or to place orders fraudulently or in bad faith.
13. Intellectual property
The Hawthorne & Reed name and marks, our written content, our product names and our page design belong to us or our licensors, and may not be copied or reused commercially without our written permission. Some product imagery remains the property of its respective owners.
14. Reviews and content you submit
If you send us a review, photograph or other content, you keep ownership of it and grant us a non-exclusive, royalty-free license to display it on our site and in our marketing. We publish reviews as written, edited only for length, and we disclose where a reviewer received a piece free of charge. Please do not submit content you do not have the right to share.
15. Communications
By placing an order, you agree that we may email you about it, including confirmations, delivery updates and anything we need to resolve with you. We send marketing email only if you have agreed to receive it, and you can unsubscribe at any time using the link in any marketing email. How we handle your information is set out in our Privacy Policy.
16. Third-party links
Our site may link to sites we do not control. We are not responsible for their content, their products or their privacy practices.
17. Disclaimer of warranties
Except where the law says otherwise, this site and its content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the site will be uninterrupted or error-free. This section concerns the website; warranty on the pieces themselves is covered in section 10.
18. Limitation of liability
To the fullest extent permitted by law, Hawthorne & Reed will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising out of your use of this site or any piece bought through it. To the fullest extent permitted by law, our total liability in connection with any order is limited to the amount you paid for that order.
Nothing in this section excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited.
19. Indemnity
You agree to indemnify Hawthorne & Reed against claims, losses and reasonable costs arising from your breach of these terms or your misuse of the site.
20. Events outside our control
We are not responsible for a delay or failure to perform caused by events outside our reasonable control, such as severe weather, natural disasters, carrier or port disruption, or government action. If such an event affects your order, we will tell you, and if it cannot be delivered within a reasonable time you may cancel it for a full refund.
21. Governing law
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. The courts of California have jurisdiction over any dispute, except where the law of the state in which you live gives you the right to bring proceedings there.
22. Changes to these terms
We may update these terms from time to time. We will post any revised version on this page and update the date at the top. The version in force when you place an order is the version that applies to that order.
23. Severability and entire agreement
If any provision of these terms is found unenforceable, the remaining provisions continue in force. Together with our Privacy Policy, Shipping Policy and Refund Policy, these terms are the entire agreement between us. Where these terms and the Shipping Policy or Refund Policy differ on a specific point, the more specific policy applies.
24. Contact
Questions about these terms can be sent through the contact page or to hello@hawthorneandreed.com. We answer Monday to Friday, excluding U.S. public holidays, on Pacific time, and reply within one business day. Formal or legal notices may be sent by mail to Hawthorne & Reed, 2471 North Naglee Road, Suite 100 #1134, Tracy, CA 95304, United States.
